If you are in need of a probate fiduciary bond, we are here to help.

They guarantee honorability and compliance with all court orders and their related laws and statutes. They are designed to ensure correct accounting, or that estate debt and related fees are paid. Such bonds do not need to adhere to the deceased person’s wishes, as the court may deem the individual’s desires inadmissible. Probate fiduciary bonds are also used for an “estate of an incompetent,” or a person too ill or mentally incapable of making financial decisions. Elderly parents with Alzheimer’s disease or dementia are among the most common reasons for this type of probate bond.

They are necessary when a third party is named as the caretaker of a person’s estate and finances. Bonding requirements may be waived by the court; however, the third party is usually a family member or a family attorney.
